As an alternative to the Courts, arbitration can provide a favourable forum in which to resolve disputes. The power and ability to arbitrate arises by contract or mutual agreement by the parties.
Hearings are held in private and the proceedings are confidential and the award is as enforceable as a judgement from Court. Therefore, arbitrations are particularly well suited where confidentiality is of the highest importance and the parties seek to maintain their on-going commercial relationship.
